In the following we would like to briefly explain the terms of use of our website. By placing an order, you acknowledge that you have read and understood the following terms and conditions and agree to be bound by them in full.



DELIVERY

Shipping is done by DHL, Post, FedEx or Hermes parcel shipping. Delivery usually takes no more than 7 working days. If some items are not in stock, the delivery of the goods will be delayed by two weeks. If the goods are not available due to a possible discontinuation of production, we are entitled to terminate the contract unilaterally. You will be informed immediately about the non-availability of the goods and your already made payment will be refunded immediately. Further claims are expressly excluded. Our terms of delivery and payment apply exclusively to all deliveries. Deviating regulations of the orderer require our agreement. All cases of force majeure shall release us from our obligation to perform the contract for the duration of their effects. In the event of an impediment to delivery caused by the customer, the customer shall bear all costs incurred and arising.

RECLAIMS

Complaints regarding incorrect deliveries or shortages must be made in writing or by telephone within 14 days of receipt of the goods. Returns may only be made after consultation in order to avoid unnecessary costs or waiting times for you and us. In the case of justified complaints, free replacement or rectification will be made within the statutory warranty.


RETURN / RIGHT OF REVOCATION 

You can return the received goods within 14 days from receipt in the original condition without any reason. The return delivery costs are carried by customer.
If, after revocation, you do not return our products in whole or in part, or if you return them in a deteriorated condition, you are legally obliged to compensate us for the loss of value. This does not apply insofar as you have merely inspected our goods, as you could have done, for example, in a retail store. However, any use of the goods going beyond this entitles us to claim compensation, which under certain circumstances may reach the amount of the purchase price. Therefore, if you are considering a revocation, please limit yourself to a visual inspection and do not use the goods regularly.

LIABILITY

The liability of upbeads e.K. arising from a breach of collateral duties, in particular protective duties, is excluded. Excluded from this exclusion is the liability for damages based on a grossly negligent breach of duty by upbeads, its legal representatives or its vicarious agents, in case of injury to life, body or health or in case of breach of an essential contractual obligation, the liability for damages based on an intentional or negligent breach of duty is furthermore excluded from the exclusion. The same applies to the direct liability of the legal representatives and the vicarious agents of upbeads.

CONTRACT

You make a binding offer to conclude a contract by going through the online ordering process, entering the information requested there, and clicking the "Order" button in the last ordering step. After you have sent your order, we will send you an e-mail confirming receipt of your order by us and listing its details. This confirmation of receipt does not represent an acceptance of your offer, but is only intended to inform you that we have received your order. The purchase contract is only concluded by the dispatch of an order confirmation. At the latest until the delivery of the goods you will receive all customer information from us, which you should print out for your records.
